Upon delivery of the housing the assessment of the premises is a step often overlooked.

Indeed, this procedure may seem tedious but it allows to set the parameters of the condition of the dwelling on a fixed date or upon departure of the tenant or the arrival of a new tenant in order to avoid conflicts with these.

In a recent judgement of the Court of Québec, Small Claims division1, the Court dismissed the claim for damages by a Syndicate of co-owners against two of its co-owners for damages caused by the overflowing of the toilet of their unit. The overflow occurred a few minutes after the plumber of the Syndicate had made repairs to the toilet.

The owner testifies before the Régie du logement that, after the departure of the tenants, he found that their dwelling had been left to him in bad condition and also full of dirt. He filed, as evidence, a series of photos showing the damage to this property as of July 3, 2011, after the departure of the tenants.
