The delays to change a lease
1. Fixed lease of one (1) year or more:
The notice must be given within a period of three (3) to six (6) months.
Solidarity ensures that each one of the debtors (the tenants) can be held separately liable for the entire obligation (rent or other). Under Section 1525 of the Civil Code of Quebec, solidarity between debtors is not presumed.
The sale of a property does not extinguish the rights of the tenants. The new owner has, vis-à-vis the tenant, the rights and obligations resulting from the lease. Before purchasing the property the buyer should check the tenants’ leases to determine the extent of her/his obligations. Otherwise surprises can happen!
